Sashua Benay Retreat and Live Event Terms & Conditions – Australia

Effective date: 24 July 2026

These Terms & Conditions apply to retreats, workshops and retreat-style live events hosted or organised by Sashua Benay, including events delivered with a co-host, facilitator or collaborating organisation.

The relevant event page, booking form, confirmation email or invoice will set out the event date, location, inclusions, price, payment arrangements and any additional event-specific conditions. If an event-specific condition is inconsistent with these Terms & Conditions, the event-specific condition will apply to the extent of the inconsistency, subject to applicable law.

By purchasing a ticket, paying a deposit, entering a payment plan, attending, participating in or continuing to participate in an Event, you confirm that you have read, understood and agreed to these Terms & Conditions.

These Terms & Conditions should be read together with Sashua Benay’s Privacy Policy and Website Disclaimer, where applicable.

1. Definitions

In these Terms & Conditions:

“Event” means any retreat, workshop, live event, retreat-style experience or related activity hosted or organised by Sashua Benay to which these Terms & Conditions apply.

“Organiser”, “Sashua Benay”, “we”, “us” or “our” means Sashua Benay, ABN 39 203 153 033.

“Participant”, “you” or “your” means the person who books, pays for or attends an Event.

“Event Materials” means any written, digital, recorded or other materials, frameworks, exercises, workbooks, slides, resources or content supplied or presented in connection with an Event.

“Services” means the Event and any associated services expressly included in the booking.

2. Bookings and Payment

Your place is secured once the required ticket payment or deposit has been received and your booking has been accepted.

Depending on the Event, bookings may require payment in full, a non-refundable deposit followed by a balance payment, or payment through an agreed payment plan.

All payments must be made by the due dates stated on the Event page, invoice, booking confirmation or payment agreement. If a payment is overdue, Sashua Benay may suspend or cancel the booking after providing reasonable notice.

You are responsible for ensuring that the information supplied with your booking is complete and accurate.

3. Prices, GST and Fees

Unless expressly stated otherwise, prices are exclusive of GST. Where GST applies, it will be added to the price and shown at checkout, on the invoice or in the payment agreement. Some Event prices may be advertised as GST-inclusive, in which case this will be clearly stated.

Booking, card processing, platform or payment processing fees may be charged separately. Unless otherwise required by law, these fees are non-refundable once incurred.

4. Deposits and Payment Plans

Where a deposit is required, the deposit secures your place and is non-refundable for change-of-mind cancellations, subject always to your rights under the Australian Consumer Law.

Any remaining balance must be paid by the published due date. If you enter a payment plan, you remain responsible for completing the agreed payments unless your booking is cancelled or transferred in accordance with these Terms & Conditions or applicable law.

Failure to make an instalment does not automatically cancel your remaining payment obligations.

5. What Is Included

Your booking includes only those items expressly listed on the relevant Event page, booking confirmation or invoice. Depending on the Event, inclusions may include:

retreat sessions, workshops and facilitated experiences;

meals and refreshments;

accommodation;

venue facilities;

Event Materials; and

activities listed in the published program.

Program details may be adjusted where reasonably necessary while maintaining the overall purpose and quality of the experience.

6. What Is Not Included

Unless expressly stated otherwise, your booking does not include:

transport to or from the venue;

flights, fuel, parking or public transport costs;

travel or accommodation outside the advertised package;

personal expenses;

optional treatments or activities;

travel, medical or other insurance; or

services not listed as an inclusion.

Any optional coach, transfer, carpool or shared transport arrangement may involve an additional cost payable by the Participant.

7. Participant Cancellations

Tickets and Event payments are non-refundable for change of mind, personal circumstances or inability to attend, except where required by law.

If you cancel more than 14 days before the Event begins, amounts paid may be transferred as a credit towards another eligible Sashua Benay event, retreat, program or service. Any credit is subject to availability, must be used within the period advised when issued, is not redeemable for cash and may exclude non-refundable booking fees or third-party costs already incurred.

If you cancel within 14 days of the Event, no refund or credit will be offered because venue, catering, accommodation, supplier and Event commitments will generally have been finalised.

Different cancellation arrangements may be specified for a particular Event. Where that occurs, the Event-specific policy will apply.

Nothing in this clause limits any rights or remedies available under the Australian Consumer Law.

8. Transferring Your Booking

You may request to transfer your booking to another suitable person by notifying Sashua Benay in writing before the Event. You are responsible for arranging the transfer and providing the replacement Participant’s full name, contact information, dietary requirements and any relevant health or accessibility information.

A transfer may be declined where the replacement Participant does not meet the Event’s eligibility requirements, accommodation or supplier arrangements cannot reasonably be changed, the request is made too late to administer safely, or the transfer would materially affect the Event experience.

The replacement Participant must agree to these Terms & Conditions. Any outstanding balance remains payable before the transfer is completed.

9. Event Cancellation by the Organiser

If Sashua Benay cancels an Event and is unable to provide the booked Services, Participants will be offered an appropriate remedy in accordance with the Australian Consumer Law. Depending on the circumstances, this may include a refund, transfer to another Event or another suitable remedy.

Sashua Benay is not responsible for unrelated expenses Participants choose to incur, such as flights, additional accommodation or transport, except where liability cannot lawfully be excluded. Participants are strongly encouraged to purchase appropriate travel insurance before making non-refundable travel arrangements.

10. Postponement, Relocation and Event Changes

Sashua Benay may make reasonable changes to an Event where necessary, including changes to the schedule, sessions, activities, catering, facilitators, speakers, suppliers, venue spaces, start or finish times, or indoor and outdoor components. Changes will be made with care to preserve the overall purpose and quality of the Event.

If an Event is postponed, relocated or materially changed, available remedies will depend on the circumstances, the nature of the change, these Terms & Conditions and the Australian Consumer Law. Where the Organiser makes a major change, Participants may be entitled to a refund or other remedy.

11. Circumstances Beyond Reasonable Control

An Event may be affected by circumstances beyond the reasonable control of the Organiser, including bushfire, flood, extreme weather, natural disaster, pandemic, public health emergency, government restriction or direction, venue closure, transport interruption, utility failure, civil disturbance, or serious illness or emergency affecting an essential facilitator.

Where this occurs, Sashua Benay may reasonably postpone, relocate, modify or cancel the Event. Any refund, credit, rescheduling option or other remedy will be determined in accordance with applicable law and the circumstances. Nothing in this clause removes rights that cannot be excluded under the Australian Consumer Law.

12. Travel and Insurance

Participants are responsible for arranging safe and suitable transport to and from the venue unless transport is expressly included in the booking.

Any carpooling, shared coach or station transfer coordinated by the Organiser is provided as a practical arrangement only. Unless Sashua Benay is expressly identified as the transport provider, the transport service may be supplied by an independent third party. Participants remain responsible for assessing whether an arrangement is suitable for them.

Travel insurance is strongly recommended, particularly for Events involving accommodation or travel outside your local area. Insurance should be considered for cancellation, illness or injury, transport disruption, accommodation, personal belongings and other non-refundable expenses.

13. Health, Accessibility and Medical Information

You are responsible for deciding whether the Event is suitable for your physical, mental and emotional wellbeing and for obtaining appropriate professional advice where required.

You must advise the Organiser before the Event of any relevant medical condition, injury, mobility or accessibility requirement, allergy, dietary requirement, pregnancy-related consideration, or mental health concern that may affect safe participation or require reasonable adjustment.

Providing information does not guarantee that every need can be accommodated. Sashua Benay may request further information and may decline or limit participation where the Event cannot reasonably or safely meet a person’s needs, subject to applicable discrimination and consumer laws.

If you are receiving treatment from a medical, psychological or mental health professional, or have a condition that may affect your participation, you should seek appropriate professional advice before attending.

14. Emergency Assistance

If the Organiser reasonably believes that you require urgent medical or emergency assistance during an Event, you authorise reasonable steps to be taken to obtain that assistance. Any medical, ambulance, transport or other third-party costs remain your responsibility, except to the extent the cost arises from a matter for which Sashua Benay is legally liable.

15. Coaching and Educational Nature of the Services

Events delivered by Sashua Benay are educational, developmental and coaching experiences intended to support personal, professional and business growth. They are not counselling, psychotherapy, psychiatric treatment, medical treatment, legal advice, financial advice or any other regulated professional service.

No therapeutic, medical, financial, business or personal outcome is guaranteed. Participants remain responsible for their own decisions, actions and wellbeing during and after the Event.

16. Food, Allergies and Dietary Requirements

Dietary requirements must be provided during registration or by the deadline advised for the Event. Reasonable efforts will be made to accommodate disclosed requirements; however, catering may be prepared in shared kitchens or environments where common allergens are handled.

Neither the Organiser nor the caterer can guarantee that food will be completely free from allergens or cross-contamination. Participants with severe allergies or specific medical dietary needs remain responsible for assessing the suitability of food, carrying any required medication and discussing concerns before attending.

17. Participation and Personal Responsibility

Participation in sessions and activities is voluntary. You are responsible for listening to your body and personal limits, choosing whether to participate in an activity, following reasonable safety instructions, seeking professional advice where required and informing a facilitator if you feel unwell or unsafe.

You may decline or discontinue an activity at any time. Choosing not to participate in a particular activity does not ordinarily entitle you to a refund or credit.

18. Outdoor, Movement and Experiential Activities

Some Events may include outdoor sessions, walking, nature experiences, breathwork, meditation, gentle movement or other experiential activities. Activities may proceed in most weather conditions where it is considered safe to do so.

Participants are responsible for wearing suitable clothing and footwear, using any equipment appropriately and following all venue and facilitator instructions. Activities may be altered, moved indoors or cancelled where conditions are unsafe or unsuitable.

19. Venue Rules and Directions

Participants must comply with all reasonable Event and venue rules, safety procedures and directions given by Sashua Benay, facilitators, venue staff and authorised suppliers. This includes requirements relating to restricted areas, use of facilities, alcohol, smoking, fire safety, noise, accommodation and protection of the venue or surrounding environment.

Participants are responsible for any loss or damage they cause to a venue, accommodation, equipment or property through deliberate, reckless or negligent conduct.

20. Respectful Conduct

Events are intended to be respectful, safe and supportive environments. Participants must behave appropriately towards other Participants, facilitators, venue staff, suppliers and members of the public.

Unsafe, threatening, discriminatory, harassing, disruptive, intoxicated or seriously disrespectful behaviour will not be tolerated. Sashua Benay may refuse admission, limit participation or require a Participant to leave if their conduct creates a safety risk, breaches venue requirements or materially disrupts the Event.

No refund or credit will be provided where refusal or removal results from the Participant’s own conduct, subject to applicable law.

21. Confidentiality and Group Sharing

Participants may hear personal stories or information shared by other attendees. You agree to respect the privacy of others and not disclose another Participant’s personal story, identity or confidential information without their permission.

While facilitators will encourage respectful confidentiality, the Organiser cannot guarantee the conduct of every Participant. You should exercise care and personal judgement when choosing what to share in a group setting.

22. Photography and Video by the Organiser

Photography and video may occur during an Event. Where you have provided consent during registration or otherwise in writing, photographs or footage containing your image or voice may be used by Sashua Benay, an identified co-host or the Event photographer for websites, social media, promotional material, Event recaps, advertising and archival purposes.

You may decline promotional photography through the registration process or by notifying the Organiser before the Event. Reasonable efforts will be made to respect your preference, although you may appear incidentally in wide group or background footage. Where practical, designated photographic activities or areas will be identified.

You may withdraw consent for future use by contacting Sashua Benay in writing. Withdrawal will not affect material already lawfully published, distributed or committed to production before the withdrawal was received.

23. Recording by Participants

Participants must not make audio, video or photographic recordings of sessions, presentations, activities, Event Materials or other Participants without the prior permission of Sashua Benay and any person who may be recorded.

Short personal photographs may be permitted where they do not interrupt the Event, infringe another person’s privacy or capture protected Event content. The Organiser may require recording or photography to stop at any time.

24. Intellectual Property

Unless otherwise stated, all intellectual property rights in the Event, Event Materials and content presented or supplied by Sashua Benay remain owned by Sashua Benay or the relevant third-party owner.

Event Materials are provided to Participants for their own personal or internal business use only. You must not copy, reproduce, publish, distribute, sell, license, adapt, teach, present, record, upload, share or commercially exploit any Event Materials or substantial part of the Event without prior written permission.

You may use general ideas and personal insights gained through participation in your own life or business, but you must not represent Sashua Benay’s proprietary frameworks, wording, materials or methods as your own.

25. Personal Belongings

Participants are responsible for their own belongings. To the extent permitted by law, the Organiser is not responsible for loss, theft or damage to personal property unless caused by the Organiser’s failure to exercise reasonable care.

26. Liability and Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

To the extent permitted by law, Sashua Benay is not liable for loss, injury or damage caused by a Participant’s failure to follow reasonable instructions, an undisclosed condition or requirement, the conduct of another Participant or independent third party, travel disruption, circumstances beyond the Organiser’s reasonable control, or risks inherent in activities voluntarily undertaken.

These limitations do not apply where liability cannot legally be excluded, including for reasonably foreseeable loss caused by a failure to meet applicable consumer guarantees or by the negligence or unlawful conduct of Sashua Benay.

Where liability can lawfully be limited but not excluded, Sashua Benay’s liability will be limited to the remedies permitted by law.

27. Personal Information and Privacy

Personal information may be collected and used for processing bookings, delivering the Event, arranging catering and accommodation, supporting safety and accessibility, communicating with Participants, and administering transfers, credits or refunds.

Information may be shared with venues, caterers, co-hosts, facilitators, photographers, transport providers or other suppliers where reasonably necessary to deliver the Event or where otherwise permitted or required by law.

Sensitive information, including health, medical, accessibility and dietary information, will be handled with care and used only for relevant Event purposes or as otherwise permitted by law. Personal information will otherwise be collected, stored and handled in accordance with Sashua Benay’s Privacy Policy available at sashuabenay.com.au.

28. Marketing Communications

Booking an Event authorises Sashua Benay and any identified co-host to send communications reasonably necessary to administer and deliver that Event.

Commercial marketing emails or messages about future retreats, programs, services or offers will only be sent where permitted by law. They will identify the sender, include relevant contact details and provide a clear and functional way to unsubscribe.

Where separate marketing consent is requested during registration, providing that consent is optional and is not a condition of attending the Event.

29. Electronic Communications and Notices

You consent to receiving booking confirmations, invoices, payment notices, Event updates, changes and other notices electronically using the email address or contact details supplied with your booking.

An electronic communication will be treated as received when it is sent, unless the sender receives a delivery failure notice or has reason to believe it was not received. You are responsible for keeping your contact details current and checking your inbox, spam or junk folders for Event communications.

A notice to Sashua Benay must be sent to sashua@sashuabenay.com.au unless another contact method is expressly stated for the Event.

30. Complaints and Concerns

Any concern should be raised as soon as reasonably possible so there is an opportunity to address it. The parties agree to communicate respectfully and make a genuine attempt to resolve any dispute before commencing formal proceedings, where appropriate.

31. General Provisions

Entire Agreement

These Terms & Conditions, together with the Event-specific booking information, invoice, payment agreement, booking confirmation and any document expressly incorporated by reference, constitute the entire agreement between you and Sashua Benay in relation to the Event. They supersede prior discussions, representations or understandings relating to the Event, except for any rights that cannot lawfully be excluded and any written variation agreed by the parties.

Severability

If any provision of these Terms & Conditions is found to be invalid, illegal or unenforceable, that provision will be read down to the minimum extent necessary or, if it cannot be read down, severed. The remaining provisions will continue in full force and effect.

No Waiver

A failure or delay by Sashua Benay to exercise a right or remedy does not constitute a waiver of that right or remedy. Any waiver must be in writing and applies only to the specific circumstance for which it is given.

Changes to These Terms

Sashua Benay may update these Terms & Conditions from time to time. The version accepted at the time of booking will ordinarily apply to that booking. Updated terms will apply to future bookings and may apply to an existing booking only where required by law, reasonably necessary for safety or Event administration, or agreed in writing. No update will remove rights that cannot lawfully be excluded.

Assignment

You may not assign your rights or obligations under these Terms & Conditions except through an approved booking transfer under clause 8. Sashua Benay may engage co-hosts, facilitators, contractors and suppliers to assist in delivering the Event, while remaining responsible for obligations that cannot lawfully be transferred or excluded.

Headings

Headings are included for convenience and do not affect the interpretation of these Terms & Conditions.

32. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of Victoria, Australia, together with applicable Commonwealth laws.

The parties submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them. Nothing in this clause prevents a Participant from exercising any right to bring a claim in another jurisdiction where that right cannot lawfully be excluded.

33. Acceptance

By purchasing a ticket, paying a deposit, entering a payment plan, attending, participating in or continuing to participate in the Event, you confirm that:

you have read and understood these Terms & Conditions;

the information you provide is accurate and complete;

you agree to comply with reasonable Event and venue requirements; and

you understand that your rights under the Australian Consumer Law and other applicable laws continue to apply.
